A recycling company which has a plant in Bastrop has been sued by the state of Texas.
The state filed suit in Travis County against Darling Ingredients, Inc. over what the state refers to as "unauthorized nuisance odor conditions resulting from the emission of air contaminants" from Darling's DAR PRO Solutions recycling plant, 264 FM 2336, Bastrop. Texas Attorney General Ken Paxton and the Texas Commission for Environmental Quality are behind the lawsuit.
The plaintiffs are asking the defendant to adhere to the Texas Clean Air Act by controlling air pollution and emissions from air contaminants. According to the lawsuit, the defendant's plant processes used cooking oil as well as raw chicken, chicken blood and chicken feathers - all of which are believed to cause the foul odors.
